General Terms and Conditions of Sale

Recitals

The Musée d’Art et de Culture Soufis MTO™ is located at 6 Avenue des Tilleuls, 78400 Chatou, France.

These general terms and conditions of sale (hereinafter the “T&Cs”) automatically apply, without any restrictions, to all single and group entry, activity and event tickets for the Musée d’Art et de Culture Soufis MTO™ (hereinafter, the “MACS MTO™”). By purchasing single or group entry or activity tickets, buyers are deemed to unconditionally accept these general terms and conditions of sale.

The purpose of these T&Cs is to set out the rights and obligations of the parties for the sale by the MACS MTO™ of tickets or other products to natural or legal persons and/or groups of natural persons on the macsmto.fr website. These T&Cs also apply for entry tickets purchased at the MACS MTO™ physical point of sale.

These T&Cs do not apply to tickets purchased from MACS MTO™ partners.

The MACS MTO™ reserves the right to unilaterally amend these T&Cs. The applicable T&Cs are the T&Cs published and available on this e-commerce website on the date on which the order is confirmed.

Clause 1 – General Provisions

All the following terms will have the meaning assigned to them below, whether they are used in the singular or in the plural:

“BUYER” means any natural or legal person, who must have reached the legal age of majority and may not be subject to any guardianship or curatorship measures, making a purchase on the e-commerce Website, On Site or via a direct telephone sale.

“TICKET” means an entry Ticket for the services provided at the MACS MTO™, purchased by Buyers on the Website or On Site. There are several types of Tickets (for exhibitions, guided tours and workshops etc.), as described in Clause 2 of these General Terms and Conditions of Sale.

“CUSTOMER ACCOUNT” means the account used by users of the Website to identify themselves and fill in a form, if they wish to place an order. Buyers can use their Customer Account to access their order history and track orders and access newsletter subscriptions and other services.

“GROUP” means any group of 11 or more visitors wishing to enjoy the MACS MTO™ services together and purchasing their Tickets as a single purchase. School trips and associations are always treated as Groups for the purposes of these T&Cs.

“WEBSITE” means the MACS MTO™ e-commerce website selling Tickets online, available, as appropriate, at: macsmto.fr

“ON SITE” means Tickets or products purchased at the MACS MTO™.

“VISITOR” means any natural or legal persons using a MACS MTO™ Ticket or attending a MACS MTO™ event. Visitors may be, but are not necessarily, a Buyer.

Clause 2 – Tickets on Sale

Several types of Tickets are sold by the MACS MTO™:

  • “exhibition” tickets: access to all the exhibitions on at the MACS MTO™ and the garden.
  • “guided tour” tickets: access to a guided tour run by a guide. Access to the garden is included in the Ticket price.
  • “workshop for adults” or “workshop for children” tickets: access to a workshop run by an artist/professional, the exhibition at the MACS MTO™ and the garden.
  • “event” tickets: one-off events may be held (concerts, shows and conferences etc.), as part of the cultural events scheduled for each season. Special Tickets will be issued for such events. The prices and admission terms may vary, for each type of event.

Other specific Tickets may be sold online and On Site, in which case these T&Cs will also apply to them.

There may be no charge for admission to some events, on production of a MACS MTO™ admission Ticket, valid on the date of the visit, subject to availability.

Tickets to visit the MACS MTO™ purchased On Site are valid on the date of purchase only.

Clause 3 – Guided Group Tours/Group Bookings

Any requests for information about Groups or Group bookings should be emailed to billetterie@sufimuseum.org

The MACS MTO™ will issue a quote for Group bookings on request, which must be signed, marked “Valid record of acceptance” and returned to it.

Once a quote has been accepted, the MACS MTO™ will send an invoice, to be paid on the Website or On Site. Payment by cheque is accepted, for payments to be made On Site.

Clause 4 – Prices

The prices and terms for discounted or free entry can be found on the MACS MTO™ Website (macsmto.fr).

Ticket prices are stated in euros and include all taxes and handling fees. The applicable Ticket price is the price published on the date of the order.

Visitors with a free or discounted Ticket must provide proof of their eligibility for the special price. Otherwise, they will be denied entry or asked to pay the difference with a full-price Ticket at the MACS MTO™ welcome desk. Likewise, any Visitors who purchase a full-price Ticket even though they are eligible for discounted or free entry may not obtain any refund, as they are deemed to waive any right to claim a discount.

Clause 5 – Terms of Purchase

The Website provides access to the MACS MTO™ online Ticket service, selling the MACS MTO™ entry and activity Tickets in real time.

Buyers place an order for one or more Tickets (up to ten Tickets for each Buyer of single Tickets) sold on the Website.

The online ordering process involves the following stages:

  • Buyers select the product they wish to purchase;
  • Buyers choose the day and time of the service from the calendar provided, where applicable. If a given time slot is not available, it is marked full in the calendar;
  • Buyers select the number of admissions required for each different price, in line with the number of available Tickets displayed in real time;
  • A summary of the entire order is displayed and Buyers check the order and confirm it is correct. If the order is not correct, they can go back to the previous stage and alter their order;
  • Buyers create a customer account on the Website, by providing their contact details, or use the customer account they created when they previously purchased Tickets, by logging in using their email address and confidential code created at that time;
  • Buyers click on the “continue to payment” button, accept the T&Cs and are redirected to a secure payment server;
  • Once the payment has been confirmed, an order confirmation is displayed and Buyers receive a confirmation email with their Tickets in PDF format;
  • Buyers can print out their Tickets or download them onto their mobile telephone;
  • Buyers may also purchase products online. Such products must be collected On Site, as there is no delivery option.

Tickets cannot be returned, exchanged or refunded. They may not be cancelled, after payment has been confirmed.

All the products are also sold On Site, at the MACS MTO™ welcome desk, subject to availability. Any Visitors wishing to obtain a discounted or free Ticket On Site must provide valid proof of their eligibility at the time of purchase.

Clause 6 – Payment

Products purchased on the Website are paid for by credit or debit card, to allow Buyers to purchase products online with immediate effect, in a final and binding manner. The following cards are accepted for order payments: Carte Bleue/Visa and Eurocard/Mastercard.

The Buyer’s bank account is debited for the amount of the order, when it is confirmed. Orders are treated as effective once the agreement of the bank payment centres has been confirmed.

Under the regulations in force and to protect the security and confidentiality of their information, the MACS MTO™ does not store any bank account details provided by Buyers.

When placing an order on the MACS MTO™ Website, Buyers must save or print out their payment certificate if they wish to retain the details of their transaction.

The MACS MTO™ accepts payment by credit or debit card or cash, for purchases made On Site. Cheques (except for Groups on the terms set out in Clause 3 above) and ANCV (or similar) holiday vouchers are not accepted.

Clause 7 – Securing Payments and Personal Data

The MACS MTO™ uses the Adyen payment services for all payments made online and On Site, through Smeetz, the MACS MTO™ Ticket service.

Smeetz safeguards the absolute confidentiality of Buyer banking information by systematically checking that access rights are valid when processing payments by credit or debit card and encrypting all exchanges to protect confidentiality.

Clause 8: Terms of Use for Tickets

8.1 Use of a Valid Ticket

Tickets can be printed out when the order is confirmed by email. They can be printed out by clicking on the link contained in the order confirmation email.

Visitors wishing to print out their Tickets must do so before their visit. Tickets may not be printed out [On Site]. They must be printed out on a sheet of A4 paper in portrait mode, ensuring that the unique Ticket barcode or QR code can be scanned. Tickets can also be downloaded by clicking on the link contained in the order confirmation email and presented on a mobile telephone to gain entry.

Each Ticket issued is only valid for the date and time stated on it or for a specific period and allows one person to gain entry.

Activities and events start at the stated time: any Visitor who is late may be denied entry, without incurring the liability of the MACS MTO™ or generating any right to claim a refund.

All Tickets are systematically checked at the entrance to the MACS MTO™, using barcode scanners by special members of its team. Visitors must retain their Tickets during their visit. Tickets may only be used once and Visitors may not re-enter the MACS MTO™ once they have left.

Each Ticket is personal and non-transferable. The MACS MTO™ is not required to check the identity of the person using the Ticket. Any person using a Ticket is presumed to be the legitimate holder. Any person who subsequently attempts to use a copy of the same Ticket will be denied entry to the museum, with no right to claim a refund.

8.2 Compliance with Museum Rules and Regulations

Any person visiting the museum must comply with the MACS MTO™ Museum Rules and Regulations.
The Museum Rules and Regulations set out the visiting arrangements, including safety instructions, museum accessibility and the opening times of the MACS MTO™.

Article 9 – Ticket Modifications, Cancellations and Refunds

9.1

Pursuant to Article L. 221-28 of the French Consumer Code (Code de la Consommation), the consumer cooling-off period does not apply to Buyers purchasing Tickets.

9.2

Tickets will not be exchanged or refunded unless (i) a date or event is cancelled by the MACS MTO™, (ii) opening times are changed (including for security reasons), or (iii) changes are made to an event.

Each Ticket is personal and non-transferable. They may not be resold, in any circumstances whatsoever.

9.3

The MACS MTO™ undertakes to inform Buyers as soon as possible of any of the circumstances referred to in Clause 9.2 above.

The MACS MTO™ undertakes to provide a replacement Ticket of the same category for a new date, subject to availability. If a Ticket cannot be replaced by a new Ticket, Buyers may request a refund of their Ticket (but may not claim any ancillary costs such as transport, hotels or parking etc.). The Ticket will be refunded to the Buyer who ordered the Ticket and may not be refunded to any other person.

If the cancellation is caused by a force majeure event as defined by law and the courts (including bad weather, strikes, fire, water damage, illness of an artist, epidemic, changes to opening times imposed on the museum for security reasons etc.), the MACS MTO™ will not be required to exchange or refund the Ticket.

The MACS MTO™ may ask Buyers to provide any missing information it may require for a refund, including:

  • to send the original, full Ticket(s) to it,
  • to provide their bank account details (original statement of banking details obtained from their bank),
  • to provide a copy of a valid identity document.

Any refund will be made as swiftly as possible, and at the earliest within thirty (30) days of receiving a complete claim, to the exclusion of any other compensation or penalty whatsoever.

Clause 10 – Visitor Services and Order Tracking

The Visitor Services team may be contacted for further information about online sales of single Tickets, bulk Tickets, Group sales and the terms of use and purchase, by sending an email to billetterie@sufimuseum.org, calling it during the MACS MTO™ opening hours (9 a.m. to 6 p.m.) or writing to it at the following address:

Clause 11 – Liability

The MACS MTO™ may not be held liable, in any circumstances whatsoever, for any non-performance or improper performance of the services to be provided under each Ticket, caused by an act or omission of the Buyer, an unforeseeable, unavoidable act or omission of a third party or a force majeure event, as defined in Article 1218 of the French Civil Code (Code Civil).

Likewise, subject to any problems affecting the operation of the Website attributable to it, the MACS MTO™ may not be held liable for any problems or errors that may occur during the order process or the processing, downloading or printing of Tickets, caused by an act or omission of the Buyer, an unforeseeable, unavoidable act or omission of a third party or a force majeure event, as defined in Article 1218 of the French Civil Code.

The MACS MTO™ is not liable for any loss or use of the Tickets purchased by Buyers, who are solely liable for any use of such Tickets by them or a third party.

In any event, the liability of the MACS MTO™ is strictly limited to a refund of the Tickets.

Clause 12 – Operation of the Website

The Publisher of the Website makes every effort to ensure that all the information provided on its Website is accurate and up to date. However, the Publisher cannot warrant that the information it contains is complete, precise, accurate, exhaustive and error-free.

The Website is available 24/7, unless closed for maintenance or repair and subject to a force majeure event or any event beyond the control of the MACS MTO™.

The Publisher of the Website reserves the right to correct or amend the content of the Website at any time and without prior notice. It endeavours to provide a continuous, high-quality service at all times. However, the MACS MTO™ disclaims any liability in the event of any temporary or permanent content unavailability.

In addition, any attempt to hack or misuse the Website will be recorded and legal action will be taken.

Clause 13 – Governing Law and Disputes

These T&Cs shall be performed and interpreted in accordance with French law and, likewise, the sale of the products covered by these terms and conditions of sale shall be governed by French law.

In the event of a complaint, Buyers may refer the matter to a CMAP mediator in accordance with the provisions of Article L. 616-1 of the French Consumer Code or refer the matter to the Online Dispute Resolution Centre in accordance with Article 14(1) of Regulation (EU) No. 524/2013 of 21 May 2013.

If an out-of-court solution cannot be negotiated, any dispute will be subject to the jurisdiction of the appropriate Court within the judicial district of Paris.

Clause 14 – Miscellaneous Provisions

The information delivered by the MACS MTO™ Website constitutes conclusive evidence between the parties. Information such as the time of receipt or transmission, and the quality of the data received, will constitute primary conclusive evidence as recorded in the MACS MTO™ information systems or as authenticated using the MACS MTO™ electronic procedures, unless proven otherwise by Buyers in writing. The information delivered by the MACS MTO™ IT systems has the same evidentiary value as an original, meaning a written document in a paper format, signed by hand.

Clause 16 – Data Protection – French Data Protection Authority (CNIL)

Buyers are informed that their personal data collected via the Website is used by the MACS MTO™, which acts as a data controller within the meaning of Regulation (EU) No. 2016/679 of 27 April 2016 (hereinafter the “General Data Protection Regulation”).

As part of the product purchase process, the MACS MTO™ may need to collect and process the following types of data:

  • identity of Buyers: forename and surname, email address, photo (for membership cards) and date of birth etc.
  • data about their Ticket purchase history (exhibitions, events, workshops and membership cards etc.).
  • data about Tickets: use and number of scans etc.
  • Website connection and user data (for example, pages visited by customers and services used etc.).
  • data relating to the settlement and payment of transactions.

The data collected is processed electronically to manage the Ticket service and newsletters.

The Visitors Services team acts as the data controller. The data will only be passed on to authorised MACS MTO™ team members (visitors services team, legal, accounting, administrative and IT department, data protection officer) and any data processors that the MACS MTO™ may use (welcome services provider, publisher of ticket software and digital marketing agency etc.).

Under the privacy legislation in force (French Data Protection Act of 6 January 1978), Buyers have the right to access, modify and rectify their data. They also have the right to object to the use of their personal data for direct marketing purposes.

They may exercise those rights by emailing a request to cnil@sufimuseum.org, stating their forename, surname, postal address, email address and, where possible, their buyer reference number. The request must be signed and emailed with a photocopy of an identity document containing the Buyer’s signature and must specify the address to be used to respond to the request. In such a case, a response will be sent within one month of the date of receipt of the request.
